Terms of Service

These Terms of Service ("Terms") govern your use of Pixels & Floss(the "Service"), operated by Pixels & Floss. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Pixels & Floss provides tools to create, edit, brand, and export cross-stitch patterns, including cloud storage of designs for registered users and paid PDF export features for subscribers.

We may change, suspend, or discontinue features at any time. We try to give reasonable notice for material changes when possible.

You must provide accurate information when registering. You are responsible for keeping your password secure and for activity under your account. Notify us at hello@pixelsnfloss.com if you suspect unauthorized access.

Paid plans are billed through Stripe. Prices are shown at checkout. Subscriptions renew automatically until cancelled. You can manage or cancel billing through your account or the Stripe customer portal where available.

Refunds are handled at our discretion except where required by law. Chargebacks or abuse may result in account suspension.

You retain ownership of patterns, images, and other content you upload or create ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate the Service (for example, saving designs to your account and generating PDF exports).

You represent that you have the rights to use and share Your Content and that it does not infringe others' rights or violate law.

You agree not to:

• Use the Service for unlawful purposes or to distribute malware
• Upload or share content that infringes copyright, trademark, or other rights
• Attempt to access other users' accounts or data without permission
• Reverse engineer, scrape, or overload the Service
• Resell or sublicense the Service without written permission

You agree to defend, indemnify, and hold harmless Pixels & Floss, its operator, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

• Your Content, including allegations of intellectual property infringement
• Your use of the Service in violation of these Terms or applicable law
• Any dispute between you and a third party relating to patterns you create or sell

We may assume exclusive control of any matter subject to indemnification, and you agree to cooperate with our defense. This section survives termination of your account.

The Service, including software, branding, and documentation, is owned by Pixels & Floss or its licensors. These Terms do not grant you rights to our trademarks or brand assets except as needed to use the Service.

DMC colour names and numbers are used for reference only. DMC® is a registered trademark of its respective owner. Pixels & Floss is not affiliated with, endorsed by, or sponsored by DMC.

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to our designated agent with:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material on the Service and information reasonably sufficient to locate it (for example, account email and pattern name)
• Your contact information (address, telephone, and email)
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Send DMCA notices to: hello@pixelsnfloss.com (subject line: "DMCA Takedown Request"). We may remove or disable access to allegedly infringing material and may terminate repeat infringers. If you believe material was removed in error, you may submit a counter-notification with the information required under applicable law; we will forward it to the original complainant where appropriate.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Pattern dimensions, colour matches, and PDF output are tools to assist you; you are responsible for verifying patterns before stitching or selling.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXELS & FLOSS AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or pose risk to the Service. Upon termination, your right to use the Service ends; we may delete stored data after a reasonable period.

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Nova Scotia, Canada, unless applicable law requires otherwise.

Our handling of personal information is described in our Privacy Policy. For users in Canada, that policy is designed to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.
